Well, I am hoping anyway. The sun is not up yet…yes I am an early bird. But, the big news is…….We have grass!!!! I could not take a picture yesterday as it rained the whole dang day, but it is suppose to be sunny today, and I will get a photo!!!!!
The front porch is still not started. I cannot blame the guy, as who wants to work in the cold rain? He wants the job to begin, because let’s face it, he wants to be paid. It will happen, and it will happen this month. May is going to be flower month here at Possum Manor.
Oh, North Carolina had free legal advice day on Thursday. Lawyers donated their time, and you got to call in and ask questions. So, I called about how we could go about getting some of our money back from the contractor who is sitting in the Buncombe County Jail awaiting trial. What it boils down to is that we could sue him in small claims court for 5,000. ( He cheated us out of 10,000, but if we used a lawyer and won, we would only, in the perfect scenario, see half of it.)
He said they might or might not bring him to the courtroom for the case, but that we would win it anyway. Then they would put a ten year judgment on him. If he were to get out of prison and start a job, we could collect. *If he got out of prison and if he got a real job where he was reporting earnings to Social Security. * In other words, he said we would probably never see any money, even with a full judgment. So, if we do the small claims court, it would only be to make us feel better, but would it? I don’t know how I feel about this. Since we would really never see the money anyway, it would only feel like revenge. I can be a nasty, “right is right, wrong is wrong woman”, but I have never been revengeful. I would really some opinion on this.

I say, if you probably will never see any of the money from this guy, then it is probably better to just let it go. You have stressed and suffered enough from it. While let it drag out in court, causing more stress and upset in your lives, just to smack him on the hand. Karma will get him in the end, and you two have other, more important things to focus on.

i like this Maria person. You should send her teeth. In one sense she’s probably exactly right…the other view is that IF the dude gets out of prison within the ten year time frame he’ll probably be on parole or probation…which would both require him to find work to stay out of jail, AND to pay the judgement. As far as i remember interest does accrue..
however…in the end, if you balance it all out…at least two days in court for both of you, plus prep time..plus time to figure out each step…for a maybe payoff years down the road…is that worth 5k to you?
too much work, too little money in the end for me…
